Services.
We offer various services to help you manage your website, such as web design, web development, web hosting, domain registration, content creation, SEO, social media marketing, and more. You can choose the services that suit your needs and budget from our packages or request a custom quote. We will provide you with a service agreement that outlines the scope, duration, fees, and payment terms of the services you select.
Payment.
You agree to pay us the fees for the services you order in accordance with the service agreement. You also agree to pay any applicable taxes, charges, or fees imposed by any government authority. You are responsible for providing us with accurate and complete billing information and updating it as necessary. We accept various payment methods, such as credit cards, PayPal, etc. We will issue you an invoice for each payment due and send it to your email address. You agree to pay each invoice within the specified time frame.
Intellectual Property.
We respect the intellectual property rights of others and expect you to do the same. You retain ownership of any content, materials, or information that you provide to us or upload to your website. However, by doing so, you grant us a non-exclusive, royalty-free, worldwide license to use, copy, modify, distribute, display, and perform such content, materials, or information for the purpose of providing our services to you. You also grant us the right to use your name, logo, trademarks, or other identifiers in connection with our services or marketing materials. You represent and warrant that you have the necessary rights and permissions to grant us these licenses and that your content, materials, or information do not infringe or violate any third-party rights or applicable laws.
Disclaimer of Warranties.
We strive to provide high-quality services that meet your expectations and requirements. However, we do not guarantee that our services will be error-free, uninterrupted, secure, or effective. We provide our services on an “as is” and “as available” basis without any warranties of any kind, express or implied. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or compatibility.
Limitation of Liability.
To the fullest extent permitted by law, we are not liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages arising from or relating to your use of or inability to use our services or your website. This includes but is not limited to damages for loss of profits, revenue, data, goodwill, or other intangible losses. Our total liability to you for any claim arising from or relating to our services or your website is limited to the amount paid by you for the services in question during the 12 months preceding the claim.
Website Management Packages.
At the time the client chooses to discontinue the services described under “Managed Website Packages” including “Silver Subscription, Gold Subscription, e-Commerce Subscription, these products will remain property of 301 Branding unless a fee of 20x the monthly rate or a minimum of 24 months of paid service has passed. Once all requirements have been met, 301 Branding will provide the website and email in a portable format to be hosted with an alternative method. If the client chooses to take advantage of their website redesign (timing based on individual plan details), the minimum 24 month term will be reset and start again at the time the website redesign begins.
